Breaking News: NH Democratic Party files civil suit against RNC

RNC, Others Added to Existing Lawsuit Against State GOP

MANCHESTER, NH - The New Hampshire Democratic Party today added the Republican National Committee and several other Republican officials and groups to its pending civil lawsuit against the New Hampshire Republican Party, over the 2002 phone-jamming case in which two GOP officials are currently serving jail time.

"It's taken years to fight through their legal stonewalling, but it is crystal clear now that the phone-jamming was planned by the Republican Party in order to help win John Sununu's Senate seat and win back the United States Senate. And it worked," said Kathy Sullivan, Chair of the New Hampshire Democratic Party. "Now it's time for some accountability."

"The phone-jamming was a crime, plain and simple. Two men are in jail, and a third has delayed his trial only because the RNC has spent almost a million dollars stonewalling this case. Please, no more delays, excuses, disclaimers or stonewalls. Let's get to the bottom of this, and get it behind us."

In addition to the RNC, today's motion added two individuals, two Republican groups, and unidentified attorneys for these groups. According to the motion:

  • The REPUBLICAN NATIONAL COMMITTEE was the employer of James Tobin, a Republican official at the heart of the phone-jamming who has been fingered by both the men who have been convicted in the case. Tobin was acting in the scope of his duties for the RNC and specifically to achieve their goal: electing Senator John E. Sununu and reclaiming a majority in the U.S. Senate.
  • JAMES TOBIN, former Northeast Political Director for the RNC and the Regional Director for the National Republican Senatorial Committee (NRSC), conspired with other defendants (including two currently in jail for this crime) to jam phone lines at Democratic Party and nonpartisan Get-Out-the-Vote locations. Specifically, Mr. Tobin connected NH GOP Executive Director Chuck McGee with GOP telemarketer Allen Raymond for the purpose of committing this crime. Mr. Tobin's criminal trial is scheduled for later this fall, after numerous delays from his legal team (which is funded by the RNC). Mr. Tobin was also New England Chair of the Bush-Cheney 2004 campaign and was a "Ranger," raising hundreds of thousands of dollars for its effort.
  • JOHN DOWD, former Chair of the New Hampshire Republican Party (NHGOP), was aware of the planning of the crime prior to the election, then helped cover it up and gave McGee a $6,000 "bonus" after the election, despite full knowledge of the crime.
  • The REPUBLICAN LEADERSHIP COMMITTEE employed telemarketer Allen Raymond, who was convicted in a criminal court and is currently serving a jail sentence. Raymond's attorney stated in court that he was acting in his capacity as the group's regional executive director, and had cleared the crime with the RLC's staff and lawyers.
  • The NATIONAL REPUBLICAN SENATORIAL COMMITTEE was also James Tobin's employer, and the crimes he committed were done in the scope of his duties at the NRSC, and done specifically to further their agenda.
  • UNIDENTIFIED ATTORNEYS FOR THESE GROUPS were added to the lawsuit after it became apparent that in at least two cases, Republican lawyers working for these groups falsely told their clients that the activity in question was legal.

These defendants join the New Hampshire Republican State Committee:

  • Milo Enterprises and GOP Marketplace (the two firms involved in the phone-jamming); Chuck McGee, Allen Raymond, and Chris Cupit (who was part of the management at GOP Marketplace).
  • Additionally, today's motion replaced one count in the civil suit which had requested preliminary and injunctive relief (since the election is passed) with another seeking enhanced compensatory damages (since the conduct of defendants constituted malicious and oppressive acts).

"People above politics."Remember? Those words from former governor Meldrim Thomson comprise arguably the best remembered slogan in New Hampshire political history.


I personally witnessed Mel Thomson, a Republican, ill and in severe pain, force himself up from his seat to shake hands with then recently elected Democrat Gov. Jeanne Shaheen. He did it because he was a gentleman, but he also did it to show respect for the governor and for the people who elected her in a fair election a few months before.


That was yesterday.


Today we hear news that Charles McGee, the former executive director of the New Hampshire Republican State Committee, and Allen Raymond, a GOP consultant, pleaded guilty to federal charges stemming from their involvement in the jamming of telephones on Election Day, Nov. 5, 2002. Democrats' computer-generated calls to get out the vote were blocked and thus voters did not receive the intended message due to illegal action by some in the Republican Party.


At their plea hearings in U.S. District Court, McGee and Raymond admitted they spoke to an "unidentified official with a national political organization" about the illegality. As sad and deplorable as those actions were, regrettably, Republican Party officials in New Hampshire and Washington have decided to put "politics above people" and delay this much needed and urgent investigation of the facts.


Where is the outrage of elected officials and party leaders?


Wrong!


This is a far cry from the party of Lincoln that proudly and correctly stood on principle to outlaw slavery. It is a far cry from the party of great and principled statesmen like Mel Thomson, Norris Cotton, Ronald Reagan, Dwight Eisenhower and Teddy Roosevelt. What a contrast between those great Republicans and current party leaders, who refuse to speak out against this despicable action by pathetic political hacks.


James Tobin, President Bush's 2004 New England campaign chairman and the Northeast political director of the Republican Senatorial Committee in 2002, said, "These allegations date back to years and have absolutely nothing to do with the present campaign."


Wrong! Wrong! Wrong!


Mr. Tobin, these allegations have everything to do with the present campaign because the people must feel confident that the 2002 election fraud will not be repeated. The best way to restore confidence is for all those involved to tell the truth now.


Both parties have a right to expect a fair election result even if it is not always a favorable one. Tobin also said, "It is disappointing, indeed, to see the opposition party (Democrats) manipulate the court system in a blatant attempt to influence the election."


What a mind-numbing hypocritical answer that is! Who is trying to influence elections, Mr. Tobin? Please do not insult us further.


New Hampshire Democrat Party Chair Kathy Sullivan said, "The public should know Tobin's role in this, along with the roles of any other high-level GOP officials."


Kathy and I have not agreed very often, but she is absolutely correct. We need the truth now to restore confidence in the coming election. She has a right to be angry. Can you imagine the Republican outrage if the Democrats had been guilty of similar conduct? Does a party that refuses to tell the truth before Election Day deserve our vote on election day?


Fallen symbol


Political scandal is not rare in America, but it is rare in New Hampshire. This is not Huey Long's Louisiana. This is the "Live Free or Die" state. New Hampshire has fair elections, and we are proud of it.


Candidates and voters alike have justifiably placed huge confidence in our election officials, such as the highly respected Secretary of State Bill Gardner and the hundreds of precinct workers who carefully monitor the vote in polling places.


Yet for the first time in New Hampshire history, there is a cloud of suspicion over the election of a U.S. senator. What is the recourse for Gov. Shaheen if the election was unfair? She can sue, complain and even watch the guilty admit what they did, but she still is not a senator. If she lost fair and square, the issue is over. If she lost because of fraud, then the truth must set us free for fair elections in 2004 and beyond.


Daniel Webster said as he stood in awe under the Old Man in the Mountain, "The thought comes now and again that in the great State of New Hampshire the Master of Sculptures makes men."


If real men (and women) of the Republican Party do not stand on principle and put the people and the truth first before Nov. 2, it is clear that when the Old Man fell, New Hampshire lost more than just a sculpture.

That was how Bob Smith, former GOP Senator of our State thought about this last year. Laws were broken, and the responsible criminals {some of them, anyway, so far} have been sent to jail. Further actions will be determined in a court of law as to the culpability of additional parties, as pointed out in Nancy's post.

These are facts, based upon existing law, and as upheld by our courts in the State.

Criminals who break laws will go to jail, defendants found culpable in a civil case will face damages and penalties. It's good to see at least one member of the GOP like Bob Smith, who has the moral turpitude to stand for what is right.

One wonders where the rest of them could be?

Criminals abound

Barry - you are absolutely right. I remember when Bob Smith wrote this article last year. And I remember thinking how extremist our political system has become when moderates like myself begin to long for the conservative politicians like Bob Smith to get back in the game. Heck, even Richard Nixon would provide welcome relief to the fascist policies of the current administration (or is that just wistful nostalgia?). In any event, the NH GOP is being exposed as a corrupt institution that has no compunction in breaking the law to get what it wants. And even more disturbing is the cynical and out-of-touch connection the NH GOP has with outside power brokers, such as Grover Norquist and the criminal lobbyist Abramoff. It's time to hold ALL of our elected representatives accountable for their sworn allegience to the likes of Norquist and his robber baron agenda that is stripping the republic of any sense of decency, common good, and morality.

Much Ado About NOTHING

Phone jamming never was proven because it never had any effect, ill or otherwise, on the election.
And the phone bank run from the fire station was illegal to begin with. It's called 'compelled speech'.
Those people have yet to be punished for that crime.

This suit is a fishing expedition.

What happened to Jesse Burchfield? He got off with no jail time because he had a Hollywood lawyer and because he got no coverage in the media.

This supposed phone jamming didn't even have any effect whatsoever on the vote. It certainly wasn't like all the undomiciled people who voted to get Lynch in illegally that are all coming to light now. Carloads of them.

DemocRATS are never held accountable for their crimes but conservatives are crucified in the court of the press.
